Heard learned counsel for the petitioner and learned APP for the State including learned counsel for the informant. The petitioner apprehends his arrest in connection with Mokama P.S. Case No.159 of 2020 registered for offences under Sections 302, 307 and 120B/34 of the Indian Penal Code and Section 27 of the Arms Act.
The present FIR has been registered on the written statement of father of the deceased in which the petitioner and three others are named including one Ramjivan who has been injured in the case. On the fardbeyan of Ramjivan, another FIR
Patna High Court CR. MISC. No.22476 of 2021(3) dt.17-01-2022 2/2 has been registered in Mokama Police Station, Ramjivan has been examined and his statement has been recorded in paragraph 45 of the case diary in which he has named a different Mukesh Kumar alias Mukesh Singh as one of the assailants. The informant of the present case is not an eye-witness of the occurrence whereas Ramjivan is an eye-witness and injured witness.
Considering the the aforesaid, the application for anticipatory bail is allowed.
Accordingly, let petitioner, above-named, in the event of his arrest or surrender within eight weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, in connection with Mokama P.S. Case No.159 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sandeep Kumar, J) BT/- U T
