The petitioner- Deepak Chaudhary alongwith Imam Hussain has been found indulge in sale of lottery ticket in contravention of Lottery Regulation Act, whereupon apprehended and from their possession, apart from lottery ticket of Govt. of Bengal as well as Nagaland cash has also been recovered. The petitioner has got criminal antecedent as has been found habitual one.

However, considering the period of custody since 9.11.2019, the petitioner Deepak Choudhary is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in Kahalgaon P.S.Case No. 755/2019.
