Mr. Arun Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 24-02-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the office within one month.

Heard the learned counsel for the petitioners as well as the learned Additional Public Prosecutor for the State. The petitioners apprehend their arrest in connection with Ismailpur P.S. Case No. 13 of 2020 registered for offence punishable under sections 147, 149, 307, 379, 504 and 506 of the Indian Penal Code.

The informant Karelal Mandal lodged F.I.R., alleging therein that the present petitioners in drunken condition came to

Patna High Court CR. MISC. No.22277 of 2021(3) dt.24-02-2022 2/3 the house of Niranjan Sah, abused and started assaulting him. When the informant and villagers protested, the accused persons badly assaulted the informant and they also assaulted Manoj Mandal, the cousin of the informant.

The learned counsel for the petitioners has submitted that it is counter blast of the case lodged against the present informant by the petitioner no. 2, which has been lodged one day prior to the present occurrence as Ismailpur P.S. Case No. 5 of 2020.

The injury report has been called for, which is available with the record, which shows that the nature of injuries are simple.

Considering the fact that there is case and counter case and injuries are simple, let the petitioners above named, in the event of their arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Naugachia, Bhagalpur in connection with Ismailpur P.S. Case No. 13 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the
