04-03-2020 Heard learned counsel for the parties.
The petitioner apprehends his arrest in Complaint Case No. 1011 of 2016 registered for the offence under Section 420 of the Indian Penal Code.
In the complaint petition, the complainant has alleged that he paid Rs. 3,00,000/- (three lacs) to proprietor of M/s Dipro Foundation for purchasing a land, but the accused neither registered the said land in favour of complainant nor returned his money.
It is submitted on behalf of petitioner that petitioner is innocent and has committed no offence. Petitioner was only an employee of the said firm. Petitioner had not received any
Patna High Court CR. MISC. No.12992 of 2020(2) dt.04-03-2020 2/2 money from the complainant. All financial transactions were made with proprietor of the firm namely Kumar Prabhakar @ Prabhakar Singh. Petitioner is having no criminal antecedent. Considering the aforesaid facts and circumstances as well as nature of accusation, in the event of his arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 8th, Bhagalpur in connection with Complaint Case No. 1011 of 2016, subject to condition, as laid down under Section 438(2) of the Cr.P.C.
