The petitioner seeks bail in Warsaliganj P.S. case No. 31 of 2015 under Section 302, 392, 34 of the Indian Penal Code. The informant alleged that informant and his brother came to his Darwaja after closing his jewellery shop. The informant was having a bag containing gold and silver ornaments but two persons came on a motor cycle and snatched 44 gram gold and 250 gram silver from the possession of his brother. The accused persons fired which hit his brother and his brother died. The learned counsel for the petitioner submits that petitioner is not named in the FIR. The petitioner was apprehended in Sheikhpura P.S. case No. 331 of 2014, registered under Section
Patna High Court Cr.Misc. No.18791 of 2017 (3) dt.11-05-2017 2/2 379/411 of the IPC, and thereafter petitioner was remanded in this case. Save and except confession of the petitioner there is no other material to show involvement of the petitioner. The petitioner did not confess his guilt. The petitioner is in jail for last 16 months but the petitioner has not been put on T. I. parade. Considering the facts aforesaid that the petitioner was, of course, apprehended in Sheikhpura P.S. case 331 of 2014 and remanded in this case but the I.O. did not put the petitioner on T. I. parade although the petitioner is in jail for last 16 months, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-V, Nawada in Sessions Trial No. 492/2016, 716/2016), arising out of Warsaliganj P.S. Case No. 31 of 2015.
