This is an application for bail in connection with Excise Case No. 39 of 2012 registered for the offences punishable under Sections 47(A) and 47(F) of Bihar Excise Act. Learned counsel for the petitioner has submitted that nothing has been recovered from conscious possession of the petitioner rather recovery has been made from the joint house of the petitioner and he has been falsely implicated in this case and has been in custody since 21.11.2016 and has clean antecedent. Heard learned APP also, who has opposed the prayer for bail stating that huge quantity of country made liquor and Mahua have been recovered and, as such, petitioner is not entitled to bail.

Patna High Court Cr.Misc. No.6974 of 2017 (2) dt.17-02-2017 2/2 In view of the fact that huge quantity of liquor has been recovered, I am not inclined to grant bail to the petitioner. He may renew his prayer for bail after six months. With the above observations, this application is dismissed.
