In this case, the petitioner is seeking anticipatory bail in connection with Guraru P.S. Case No.78 of 2015, registered for the offence punishable under Sections 147, 148, 149, 341, 342, 323, 324, 353, 333, 337, 427, 307, 188, 504, 506, 109, 115 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation has been made that when the police party was taking the dead body of a person, which was lying near the railway track, the villagers had stopped the police and in process thereof, scuffle and brick batting took place resulting in injury to the police personnel, however, counsel for the
Patna High Court CR. MISC. No.9963 of 2020(2) dt.03-03-2020 2/2 petitioner submits that there is general and omnibus allegation against the accused persons and no specific overt act has been attributed to the petitioner. It is urged that several accused persons have been granted bail.
Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Guraru P.S. Case no.78 of 2015, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
