====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners are accused in connection with Bettiah (Mufasil) P.S. Case No. 705 of 2015 registered under Section 304(B) and 201/34 of the Indian Penal Code.

The accusation is of killing of daughter of the informant due to non-fulfilment of demand of dowry by her husband and in-laws and also disposing off of the dead body. Learned counsel appearing for the petitioners submits that petitioners are father-in-law and husband of the deceased

Patna High Court Cr.Misc. No.15124 of 2017 (2) dt.28-04-2017 2/2 respectively and both have falsely been implicated in this case by the father of the deceased due to misunderstanding. Further submission is that both are in custody since 20.02.2017.

Having considered the facts and circumstances of the case and nature of the allegation, I am not inclined to grant bail to the petitioner no.2, Brijesh Patel who is husband of the deceased. Accordingly, prayer for bail of petitioner no.2 is rejected So far petitioner no.1 Vinod Patel @ Binod Patel is concerned who is father-in-law of the deceased, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah (West Champaran) in connection with Bettiah (Mufasil) P.S. Case No. 705 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
