====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-03-2025 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 126(2), 324(4), 352, 351(2), 3(5) of the Bharatiya Nyaya Sanhita to which Section 27 of the Arms Act was added later on.

3. As per prosecution case, on 8.10.24 at about 9 PM, petitioner along with other F.I.R. named accused persons were ploughing the field of informant and when informant raised objection, this petitioner pointed pistol upon him. It is further alleged that the accused persons destroyed the crops and fled away after seeing the villagers.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this

F.I.R. has been lodged after inordinate delay of six days and there is no allegation of overt act against petitioner. Petitioner is only alleged to have pointed pistol upon informant and no one sustained any firearms injury. He further submits that for the same occurrence, one Bakhri P. S. Case No. 387 of 2024 was also filed by the police in which petitioner was granted privilege of anticipatory bail.

5. However, learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner is named in the F.I.R. and has got five criminal antecedents.

6. Considering the nature of accusation and criminal antecedents, prayer for anticipatory bail of the petitioner is refused.
