The petitioner seeks regular bail in connection with Nautan P.S. Case No. 580 of 2018 registered for the offence punishable under Section 414 of the Indian Penal Code and Sections 30(a)/36 of the Bihar Prohibition & Excise Act. The allegation is regarding recovery of about 200 liters of illicit liquor from two motorcycles when the Police had apprehended the said two motorcycles and caught the petitioner and one other co-accused person on the spot.

The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he is accused in one other case but he is on bail in the said case. It is further submitted that the petitioner is languishing in

Patna High Court CR. MISC. No.13227 of 2019(2) dt.26-03-2019 2/2 custody since 22.11.2018.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran in connection with Nautan P.S. Case No. 580 of 2018.
