This is a petition for grant of regular bail for offences under Sections 302, 386, 387, 120B and 34 of the Indian Penal Code and 27 of the Arms Act.
Some unknown person came and fired on the uncle of the informant, as a result whereof Umesh Kumar and his friend Brajesh Kumar died during the course of treatment.
Submission of the petitioner is that the informant is not an eye witness of the occurrence and similarly situated co-accused, Pintu Tiwary, has already been allowed bail by a coordinate Bench of this Court in Cr. Misc. No. 29644 of 2016. it is, further, submitted that the petitioner would not tamper evidence not will make any default in progress of the trial. The petitioner is in custody since 03.03.2016.

No.12938 of 2017 (2) dt.22-03-2017 2/2 Considering the aforesaid fact, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Sessions Trial No. 146 of 2016 arising out of Baheri P.S. Case No. 270 of 2015 to the satisfaction of the Sessions Judge, Darbhanga, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case and if the Court below would come to notice that the petitioner has committed similar type of offence in future, the Court below shall be at liberty to cancel the bail bond of the petitioner in this case also.
