The petitioner has preferred this application for grant of regular bail in a case registered under sections 22(C) and 27(A) of the N.D.P.S. Act.

As per the prosecution case, 133.510 kgs of ganja was recovered from the vehicle in which the petitioner was also present.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The learned court below has committed an error of record as the quantity of ganja recovered even as per the F.I.R. was not 133.510 kgs but 77.460 kgs. The petitioner has no criminal antecedent and is in custody since 16.6.2020. There is no progress in the case in the learned court below.

Having heard learned counsel for the parties and taking into consideration the facts of the case whereby large quantity of ganja was recovered from the vehicle in which the petitioner was also present, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
