JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-01-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody since 27.11.2021 in a case registered for the offences punishable under Sections 354, 354(C), 354(D), 385, 504 of the Indian Penal Code.

It is alleged against the petitioner that he created fake ID on social media in the name of the informant and uploaded vulgar video and pictures of the informant.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely

It is further submitted that for the same set of offence, the informant had earlier lodged Shivsagar P.S. Case No. 115 of 2021 and when the petitioner was granted bail in the aforesaid case, the informant has again lodged the present case. There is no substantial proof that petitioner had uploaded the video and picture of the informant on social platform. The petitioner is in custody since 27.11.2021.

Considering the nature of accusation and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sasaram, Rohtas in connection with Shivsagar P.S. Case No. 263 of 2021.
