JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 06-04-2016 Heard Mr. Girish Chandra Sharma, the counsel for the petitioner and Md. Sufiyan, APP for the State. The petitioner herein seeks anticipatory bail in Hulasganj P.S. Case No. 40 of 2009 under Sections 304B and 201/34 of the Indian Penal Code.

Mr. Sharma, after having made submissions at some length, seeks permission of the Court to withdraw the application so that the petitioner may surrender and pray for regular bail.

The prayer is allowed. In case he does so, the same shall be considered and disposed of on its own merit by the Trial Court unprejudiced by the present order.
