JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-03-2020 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in connection with Giriyak P.S. Case No. 361 of 2017 for the offence under Sections 406, 419, 420 and 120(B) of the Indian Penal Code. Allegation against the petitioner is that he introduced the informant as a proprietor of the truck. The truck was engaged for carrying rice, but instead of reaching its destination, the truck loaded with rice disappeared.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the informant suspected his foul play only because he introduced the informant with the owner of the truck. He further submits that there is delay of 15 days in lodging the F.I.R.
