2. In the present case, the petitioner seeks bail in connection with Pandaul P.S. Case No. 252 of 2024 registered for the alleged offences under Sections 309(6) of the BNS 2023 and 27 of the Arms Act.

3. As per the prosecution case, four miscreants riding two motorcycles stopped the motorcycle of the informant and snatched his shoulder bag containing Rs 40,000/-. They pushed down the informant and shot at him at his left thigh. Miscreants took away motorcycle, shoulder bag and mobile phone of the informant. The name of the petitioner transpired in the investigation as one of the accused persons

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.11154 of 2025(2) dt.06-03-2025 2/3 petitioner is innocent and has been falsely implicated in this case. Nothing incriminating has been recovered from the person or possession of the petitioner. The petitioner has been made accused in this case merely on suspicion and on the basis of self confessional statement of co-accused Saurabh Kumar Yadav and also on the basis of confessional statement of the petitioner. However, the petitioner has not been put to Test Identification parade and there is no material to connect the petitioner with the offences as alleged. Petitioner is having antecedent of two cases and he is in custody since 16.11.2024 and charge sheet has been submitted.

5. Learned APP opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and submission of charge sheet, the petitioner above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M Madhubani in connection with Pandaul P.S. Case No. 252 of 2024, subject to the following conditions : (i) One of the bailors will be a close relative of the

(ii) The petitioner will remain present on each and every date fixed by the court below.
