JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-03-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Semra (Chiutaha) P.S. Case No. 73 of 2019 for the offence under Sections 341, 323, 324, 354, 307, 504 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The scuffle took place on account of plucking of ripe guava. It is alleged that one Maya Devi assaulted the injured by axe but there is no allegation of assault by any weapon against this petitioner. Considering the fact that the petitioner has no criminal antecedent and there is no allegation of assault by any weapon against him, the Court is inclined to grant bail to the petitioner, in the event of arrest or surrender within four weeks from today,

Patna High Court CR. MISC. No.9921 of 2020(2) dt.04-03-2020 2/2 on furnishing bail bond of Rs.50,000/- (Fifty thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Bagaha, West Champaran in connection with Semra (Chiutaha) P.S. Case No. 73 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
