The petitioners seek bail in Excise Case No. 24/2020, arising out of Bhabua P.S. case No. 10/2020, registered u/s 37 (i) (ii) of the Bihar Prohibition & Excise Act. The petitioners were found and arrested in inebriated condition with Uttam Patel and Anil Patel.

The learned counsel for the petitioners submits that the petitioners are accused in one more case being Bhagwanpur P.S. case No. 57/2018 registered u/s 379 and some minor sections of the IPC. The petitioners are in custody since 05.01.2020. The petitioners have already remained in jail for about two months.

No.10961 of 2020(2) dt.02-03-2020 2/2 Considering the facts aforesaid and the nature of allegation made against the petitioners, the petitioners, above named are directed to be enlarged on bail on their furnishing bail bond of Rs. 5,000/- (rupees five thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-III-cum-Special Judge, Excise Act, Kaimur at Bhabua in connection with Excise Case No. 24/2020, arising out of Bhabua P.S. case No. 10/2020.
