The petitioner is apprehending his arrest in connection with Town P.S. Case No. 672 of 2020 pending in the Court of learned ADJ-II-cum-Special Judge (Excise Act), Katihar, District- Katihar in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

It is a case of recovery of about 10 liters of country made wine from the courtyard of the house of the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the petitioner has got clean antecedent.

Patna High Court CR. MISC. No.22372 of 2021(4) dt.10-03-2022 2/2 Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In view of the fact that the said country made wine was recovered from the courtyard of the house of the petitioner, as such, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail is rejected. (Sunil Kumar Panwar, J) Brajesh Kumar/- U
