1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with S.T. Case No. 346 of 2025, arising out of Rosera P.S. Case No. 233 of 2024, registered for the offence punishable under Section 103 of the B.N.S.
3. The main submissions advanced by petitioner's counsel are that this is the second attempt of the petitioner to get the relief of regular bail, though his earlier prayer has already been rejected by this Bench vide order dated 13.08.2025 passed in Cr. Misc. No. 31133 of 2025 and the fresh grounds for renewing the prayer are the petitioner's long incarceration period as he has been languishing in jail since 19.10.2024 and the absence of significant progress in his trial and the fact that

No.11266 of 2026(4) dt.19-06-2026 2/3 all the material witnesses of the prosecution have already been examined in the trial of the petitioner which only several formal witnesses remain to be examined which may result in further delay in conclusion of the trial of the petitioner. It is lastly submitted that though against the petitioner there are criminal antecedent of five case but he is on bail in all the said cases and one co-accused namely, Rahul Singh @ Rahul Raj has already been granted bail and one of the material witness of prosecution namely, Ramanuj Singh upon whose statement the petitioner was implicated in the present case has partly turned hostile before the trial court and has made contradictory statements in his evidence with regard to the presence of the petitioner at the alleged place during the relevant time, a copy of his depositions has been filed with this petition and the same may be perused.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioner.
5. Considering the aforesaid submissions and mainly taking into account the petitioner's present custody period and slowness of the prosecution in producing and examining the prosecution witnesses coupled with the partial hostility of the said material witness, this court is now inclined to release him on bail. Accordingly, let the petitioner named-above be released

No.11266 of 2026(4) dt.19-06-2026 3/3 on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with S.T. Case No. 346 of 2025, arising out of Rosera P.S. Case No. 233 of 2024.
