The petitioner seeks bail in connection with Kochadhaman P.S. Case No. 150 of 2019, registered under Sections 457, 380 and 401 of the Indian Penal Code. The accusation is that on 06.06.2019, at about 5.30 A.M., when informant woke up, he found the box containing ornaments, cash and clothes etc. were missing from his house. In course of search, he found the said box in the field and articles were found scattered hither and thither. The informant came to know from Kaisar Alam and Nehal Alam that, in the night, one Nurshad Alam @ Don along with two others were found in the orchard of the village, who is habitual thief. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. and his name surfaced in the confessional statement of co-accused Mr. Raja. Further submission is that, in fact, petitioner is accused in four cases, as detailed in paragraph No.3, due to that reasons, the Police got implicated the petitioner showing his name in the confessional statement of co-accused Mr. Raja. The petitioner is in custody since 15.07.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Kochadhaman P.S. Case No. 150 of 2019. Out of two sureties, one surety must be parents/close relative of the petitioner.
