The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, about 834 litres of IMFL was recovered from a parked truck and the petitioner who was nearby was taken into custody.

It is submitted by learned counsel for the petitioner that he has been falsely implicated in the case. He is a 19 year old boy having no concern either with the seized liquor nor with the truck question. He is in custody since 12.12.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and in

Patna High Court CR. MISC. No.22295 of 2021(2) dt.17-09-2021 2/2 view of the petitioner not having any criminal antecedent, Court directs the petitioner to be enlarged on bail in connection with Ismailpur P.S. Case no. 105 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District and Sessions Judge -cum-Special Judge, Excise Act, Bhagalpur.
