The petitioners apprehend their arrest in Sherghati (Dobhi) P.S. case No. 593 of 2018 registered under Section 341, 323, 324, 448, 379, 504/34 of the Indian Penal Code. The learned counsel for the petitioners submits that informant is wife of own brother of Chandrika Singh, petitioner No.2. There is land dispute between the parties and no injury is found on the person of informant. The allegation of theft is ornamental and other offences are bailable.

Considering the facts that petitioners are own brother and nephew of husband of informant and there is land dispute between two sides, the petitioners, above named, in the event of

No.12716 of 2019(2) dt.01-03-2019 2/2 their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Sherghati (Dobhi) P.S. case No. 593 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
