JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-04-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under sections 376/511 and 324/34 of the Indian Penal Code.
It is alleged that on 16.6.2014 the daughter of the informant was taken by the petitioners and one Subansh Manjhi to their house with intention to commit rape when co accused Subansh Manjhi caused injury on the cheek of informant's daughter by teeth bite.
It is submitted by learned counsel for the petitioners that for the occurrence of 16.6.2014 the FIR was registered on 12.7.2014. Statement has been made in paragraph 3 of the petition
Patna High Court Cr.Misc. No.9997 of 2015 (2) dt.28-04-2015 2/2 that the petitioners have no criminal antecedent. More over, there is no medical examination of the victim.
Considering the delayed lodging of the FIR, in view of this court it is a case for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Bathnaha P.S. Case no. 201 of 2014 pending in the court of learned C.J.M., Sitamarhi.
