JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Bijaipur Police Station Case No. 78 of 2014 registered for the offences punishable under Sections 147, 341, 323, 379, 504, 420 of the Indian Penal Code.
There is specific allegation against the petitioner that he along with others assaulted the informant. Although the case has been registered under bailable sections except 379 and 420 of the Indian Penal Code but taking note of facts and circumstances of the case as well as criminal antecedent of the petitioner, I am not inclined to grant privilege of anticipatory bail to the petitioner,
Patna High Court Cr.Misc. No.14476 of 2015 (2) dt.07-04-2015 2/2 accordingly, his prayer for bail in connection with Bijaipur P.S.Case No. 78 of 2014, pending in the court of Chief Judicial Magistrate, Gopalganj stands rejected.
However, this order shall not cause any prejudice to the concerned court at the time of consideration of regular bail application of the petitioner.
