Petitioner apprehends arrest in connection with Jagdishpur P.S. Case No. 179 of 2019 registered for the offences under Sections 323, 504, 506, 498 (A) and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the instant case. Further submission is that the petitioner is a law abiding defense personnel and never took law in his hands. It is also submitted that the petitioner has no criminal antecedent. Patna High Court CR. MISC. No.12997 of 2020(5) dt.21-03-2023 2/2 the State opposes the prayer of bail and submits that there is direct allegation of harassing the informant against the petitioner. Moreover, petitioner being the husband failed in his duty of maintaining the informant with honour and dignity. He therefore, submits that petitioner does not deserve to be enlarged on anticipatory bail.
Considering the nature of allegation levelled against the petitioner and the submissions advanced on behalf of the parties, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for bail is accordingly rejected.
