JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-04-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under section 394 of the Indian Penal Code.
Informant's motorcycle along with mobile set and cash of Rs.1000/- were robbed. The petitioner was not named in the FIR, his name subsequently sprang up in the confessional statement of Lalo Kumar. From the impugned order it appears that the petitioner purchased the robbed motorcycle. It is submitted by the learned counsel for the petitioner that the petitioner has no criminal antecedent and there is nothing on record to suggest that the petitioner purchased the robbed motorcycle. It is further submitted that even assuming the
Patna High Court Cr.Misc. No.10199 of 2015 (2) dt.22-04-2015 2/2 accusation, no offence under section 394 IPC is made out. The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Mansi P.S. Case No. 190 of 2014 pending in the court of learned CJM, Khagaria.
This application is disposed of with the aforesaid observation/direction.
