JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 354 and 504/34 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
The prosecution case is that the accused persons including the petitioner surrounded the informant and abused by calling caste name and on protest being made, co-accused Bharat Thakur caught hold the hair of the informant and tore her blouse when petitioner made assault to the informant by fists and slaps and when the younger son of the informant, Tarkeshwar Manjhi came to rescue then co-accused Bharat Thakur assaulted him with spade. It is alleged that co-accused Arbind Singh snatched mobile of the informant.

No.6289 of 2016 (2) dt.09-02-2016 2/2 It is submitted by learned counsel for the petitioner that in the background of land dispute, the accusation has been levelled when the injury has been found to be superficial simple in nature. There is counter version of the occurrence also. The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Uchakagaon P.S. Case No. 186 of 2015 pending in the court of learned ACJM-IX, Gopalganj. Accordingly, the application is disposed of.
