JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-02-2020 The petitioner, who is in custody since 27.12.2019, seeks bail in connection with Kotwali P.S. Case No. 586 of 2019 dated 26.12.2019 instituted for the offence under Sections 420, 406/34 of the Indian Penal Code and 30(a), 54 and 57 of the Bihar Prohibition and Excise Act, 2016.

The petitioner was found to be in possession of a vehicle from which 60 litres of liquor was recovered. In several other vehicles, huge quantity of liquor has been recovered.

However, learned counsel for the petitioner submits that he has no concern with the consignment of liquor and is sought to be prosecuted in this case on the basis of mistaken identity.

Regard being had to the aforestated facts as

No.11194 of 2020(2) dt.29-02-2020 2/2 also taking into account that the petitioner does not have criminal antecedents and a similarly situated accused person has been granted bail, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Kotwali P.S. Case No. 586 of 2019.
