JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-06-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Nawada Town P.s. Case No. 15 of 2014 registered under sections 420, 467, 468, 471/34 of the Indian Penal Code.
It would appear from the F.I.R. that the name of the petitioner came in the statement of the apprehended accused Binod Yadav who disclosed before the police that at the direction of this petitioner, he was preparing Adhar Card. Contention on behalf of the petitioner is that I.A.P. Company Private Limited was authorised by the Government of India to prepare Adhar Card and the aforesaid
Patna High Court Cr.Misc. No.13192 of 2015 (3) dt.29-06-2015 A.I.P. Company Private Limited appointed the petitioner as Supervisor for the State of Bihar which is evident from perusal of annexure -2 to this petition.
Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioner, in the event of arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawadah in Nawada Town P.S. Case No. 15 of 2014 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure, 1973.
