The petitioner seeks bail in anticipation of his arrest in connection with Phulwari Sharif P.S. Case No. 237/2020 instituted for the offences under Sections 341, 323, 307 and 34 of the Indian Penal Code.

The petitioner is alleged to have assaulted the informant on his head by means of farsa. However, the injury of the informant reflects that it is simple in nature caused by hard and blunt substance.

It has been submitted on behalf of the petitioner that the dispute arose between the parties because of a competing claim with respect to a passage for which a proceeding under

Patna High Court CR. MISC. No.23291 of 2021(2) dt.24-05-2022 2/2 Section 107 Cr.P.C. is pending between the parties. Considering the afore-noted background facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-cum-S. J. -IX, Patna, in connection with Phulwari Sharif P.S. Case No. 237/2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
