The petitioner seeks bail in Rajepur P.S. Case No. 136/2016, instituted for the offence under Section(s) 364 (A), 307, 341, 342, 323, 324 and 120(B) of the Indian Penal Code. As per the written report, the son of the informant was kidnapped by 3-4 unknown persons. They came on Bolero vehicle and lifted his son. They had covered their face and also assaulted the informant with lathi and danda. The informant disclosed that one Raj Mangal Sah told him that Manoj Kushwaha and this petitioner told him that some offence is being committed at that
Patna High Court Cr.Misc. No.7885 of 2017 (3) dt.21-03-2017 2/2 place. The case diary has been received.
Learned A.P.P. pointed out that almost similar statement has been made before the police.
Learned counsel for the petitioner has submitted that other co-accused has already been granted bail vide order dated 07.02.2017 passed in Cr. Misc. No. 5576/2017 and dated 15.03.2017 passed in Cr. Misc. No. 11721/2017. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Sadar Motihari, in connection with Rajepur P.S. Case No. 136/2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
