The petitioner has preferred this application for grant of regular bail in a case registered under sections 272 and 273 of the Indian Penal Code and sections 30(a), 38 and 41 of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, on information having been received a raid was conducted and 52.5 litres of liquor was recovered from the agricultural filed of one Arun Singh. It is stated that on enquiry it transpired that two accused persons including the petitioner herein had stored the same. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of his antecedent. Neither any incriminating material

Patna High Court CR. MISC. No.22173 of 2021(2) dt.17-09-2021 2/2 has been recovered from his possession nor from his land. He has no concern with the seized liquor. He is in custody since 17.12.2020 and charge sheet has been submitted in the case. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the contents of the allegations in the FIR together with the petitioner having remained in custody for about 9 months, the Court directs the petitioner to be enlarged on bail in connection with Minapur P.S. Case no. 113 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur.
