2. The petitioner has preferred this application for grant of regular bail in connection with Lakhisarai P.S. Case No. 303 of 2024 dated 16.05.2024 registered for the offences punishable u/ss 341, 323, 337, 504, 506 read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, on 13.05.2024, the accused persons abused and pelted brick and stone in the house of the informant and threatened her if she would come out of the house they would shoot her. Again on 14.05.2024, the informant was feeding her three months old baby, suddenly the co-accused persons namely, Ashok Sahu and Sikandar Sahu came from the
Patna High Court CR. MISC. No.11284 of 2025(2) dt.18-03-2025 2/3 street and shot them which hit on the head of the informant's daughter. When the villagers chased them, all the accused persons fled away from the spot. Thereafter, the informant's daughter was taken to the hospital for treatment.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The specific allegation of firing is against the coaccused persons namely, Ashok Saw and Sikandar Saw. The allegation against the petitioner is of abusing and pelting stone in the house of the informant and the nature of allegation against the petitioner is general and omnibus. As per the injury report of the victim, the doctor found two injuries and the injuries are grievous in nature. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has seven criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 08.07.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of
Patna High Court CR. MISC. No.11284 of 2025(2) dt.18-03-2025 3/3 the like amount each to the satisfaction of learned Court concerned, Lakhisarai in connection with Lakhisarai P.S. Case No. 303 of 2024 with the condition :- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
7. The application stands allowed.
