The petitioner seeks bail in a case registered for the offence under Sections 376(D-A) and 120(B)/34 of the Indian Penal Code and Section 4 of the POCSO Act.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the victim was examined by the doctor and the victim has been found major having age of 19-20 years and the doctor has not found any external or internal injury on the person of the victim, which is evident from the medical report at

Patna High Court CR. MISC. No.12513 of 2020(2) dt.29-02-2020 2/2 annexure-3. The petitioner is rotting in judicial custody since 31.07.2019.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st, Additional Session Judge -cum- Special Judge, POCSO Act, Patna in connection with Special Case No. 142 of 2019 arising out of Phulwarisharif P.S.
