JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 30-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Terhagachh P.S. Case No.38 of 2016 registered under Section 366/34 of the Indian Penal Code.

The accusation is of enticing away the daughter of the informant by the eight accused named in the F.I.R. including the petitioner.

Learned counsel for the petitioner submits that, in fact, the petitioner is son-in-law of Brahmdeo Mahto who is pattidar of Sohan Mahto,father of the victim, due to that reason petitioner has falsely been implicated in this case.It would appear from the

Patna High Court Cr.Misc. No.9717 of 2017 (3) dt.30-03-2017 2/2 statement of the victim recorded under Section 164 Cr.P.C. that she has stated that this petitioner, Shanti Devi and Sajho Devi wife of the petitioner had given toffee to eat and thereafter she felt doziness and she was taken by them kept in Siliguri.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand)with two sureties of the like amount each to the satisfaction of Sri K.K.Choudhary, J.M. 1st Class, Kishanganj, in Terhagachh P.S.Case No.38 of 2016.
