JUSTICE BIRENDRA KUMAR ORAL ORDER 20-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 352/363(A)/498/366/504/506/509/354/120B of the Indian Penal Code and Sections 6/7 of the POCSO Act.

Allegation against the petitioner is of physical relation with the wife of the informant. The wife of the informant has stated on oath that no one has abducted her nor the petitioner was in physical relation with her rather due to torture of husband she had left the house.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of

Patna High Court Cr.Misc. No.3596 of 2017 (2) dt.20-02-2017 2/2 Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, East Champaran at Motihari/Successor Court, in connection with Pakaridayal P.S. Case No.28 of 2016.
