The petitioner seeks bail in connection with G.O. Case No. 909 of 2019, arising out of Keoti P.S. Case No. 134 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving the secret information about keeping of liquor by Kari Yadav in village Kadamtoli in mango orchard, informant along with other Police personnel reached there then saw several cartons of liquor are lying there. On seeing the Police personnel, 5-7 persons started fleeing in east direction and they succeeded to escape taking advantage of submersion of water, but they were identified as Kari Yadav, Md. Saddam (Petitioner), Sanjeet

Patna High Court CR. MISC. No.9902 of 2020(2) dt.28-02-2020 2/2 Yadav, Arjun Sah and Md. Alam. On search, 114 cartons, each containing 12 bottles of 750 ML and 86 cartons, each containing 48 bottles of 180 ML of Indian made foreign liquor recovered.

Learned counsel for the petitioner submits that the name of the petitioner surfaced in the F.I.R. due to dirty village politics. The petitioner has no criminal antecedent and he is in custody since 26.12.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cumSpecial Judge (Excise Act), Darbhanga in connection with G.O. Case No. 909 of 2019, arising out of Keoti P.S. Case No. 134 of 2019.
