The petitioners seek bail in anticipation of their arrest in connection with Dhoraiya P.S. Case No. 237 of 2020 instituted for the offences under Sections 341, 323, 307, 504 and 506/34 of the Indian Penal Code. The petitioners are alleged to have taken part in

Patna High Court CR. MISC. No.21515 of 2021(2) dt.26-05-2022 2/3 the assault. However, the specific act of assault has been attributed to petitioner No. 1.

There is a counter version of the occurrence as well.

The injuries suffered by the victims have been reported to be simple in nature.

Some dispute had occurred between the parties over a trivial matter, leading to filing of case and counter case.

However, it has been argued that accusations from both sides have been exaggerated in order to attract the mischief of the graver sections of the Indian Penal Code. Regard being had to the background facts, the petitioners, in the event of their arrest or surrender before the learned Court below within a period of four weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Dhoraiya P.S. Case No. 237 of 2020, subject to the

Patna High Court CR. MISC. No.21515 of 2021(2) dt.26-05-2022 3/3 conditions laid down under Section 438(2) of the Cr.P.C. The application stands allowed.
