The petitioner apprehends his arrest in Madhepura P.S. Case No. 655 of 2021, registered for the offences punishable under Sections 307, 323 and other allied sections of the Indian Penal Code.

It is submitted that specific allegation of assault is against co-accused Ajay Yadav, Santosh Yadav and Chhote Yadav. So far as this petitioner is concerned, there is no specific allegation of overt act against this petitioner. There is case and counter case. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of

No.12636 of 2022(2) dt.16-08-2022 2/2 receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 655 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
