2. The petitioners have prayed for regular bail in a case registered for the offence punishable under section 376, 354(B), C, 120B, 506, 504, 34 of the Indian Penal Code and Sections 4, 6 and 12 of the POCSO Act.
3. As per FIR, it is alleged that the co-accused namely Abhishek Verma @ Sonu Kumar (tuition teacher of the victim) on false pretext of getting first rank in the matriculation examination and solemnization of marriage,
Patna High Court CR. MISC. No.16066 of 2024(2) dt.12-03-2024 2/3 many times committed wrong with the victim. It is further alleged that the petitioners were also involved in this case.
4. Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. The petitioners are mother and father of the co-accused who is the main accused in this case and merely being parents of the co-accused the petitioners have falsely been implicated in this present case. The petitioners have no concern with the alleged occurrence and there is no specific overt-act has been levelled against them. It is further submitted that the the petitioners are languishing in judicial custody since 10.01.2024.
5. Learned APP appearing for the State has vehemently opposed the prayer of Bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Sare P.S. Case No. 119 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional District and Sessions
