JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Nasriganj P.S. Case No. 183 of 2019 for offences under Section 395 of the Indian Penal Code.

The allegation against the petitioner is that he was involved in snatching mobile, cash and driving license from the informant and his driver who were sitting in the pickup van. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The first information report has been lodged against unknown persons and the name of the petitioner has surfaced on the confessional statement of co-accused Himashu Rai.

Considering the fact that the petitioner has no criminal

Let petitioner, abovenamed, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram in connection with Nasriganj P.S. Case No. 183 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
