The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and sections 25(1-B)(a) and 28 of the Arms Act.

As per the prosecution case, on the police personnel catching and checking accused Rahmatullah who was roaming about in a suspicious manner near the gate of the Bank, it is stated that a firearm was recovered from his possession for which he had no explanation. It is further stated that in course of search other four accused persons including the petitioner herein started to instigate the general public.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case for oblique

Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the FIR together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Bharagama P.S. Case no. 8 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Araria.
