JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-03-2019 Petitioner seeks bail in anticipation of his arrest in connection with Barauni (Chakia) P.S. Case No. 574 of 2018, registered for the offences punishable under Sections 8, 20(b)(ii) and 22 of the Narcotic Drugs and Psychotropic Substance Act. Allegation is of recovery of 10 lakh rupees cash and 1.5 kg. of ganja from Creta vehicle of the petitioner and one Bhola Mahto was arrested with those articles. Submission of learned counsel for the petitioner is that the said Bhola Mahto has been granted bail by a co-ordinate Bench of this Court and petitioner has given his car to Bhola Mahto.

Having heard both sides and in the facts and circumstances, this application is disposed of with a direction to

Patna High Court CR. MISC. No.12868 of 2019(2) dt.01-03-2019 2/2 the petitioner to surrender within a period of six weeks from the receipt of this order and pray for regular bail, which shall be considered on its own merit as well as the fact that co-accused has been granted bail and, if possible, to be disposed of on the same day.
