The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code to which section 302 of the Indian Penal Code was added subsequently.

As per the prosecution case, the accused persons are stated to have assaulted the informant and others with various weapons. Specific allegation of assault being on the accused Ramanand Manjhi, Jamun Manjhi, Ranjit Manjhi, Rakamlal Manjhi and Manti Devi. It is further stated that all the eleven named accused persons including the petitioner herein had a hand in the occurrence.

There is no specific allegation against this petitioner who is in custody since 14.8.2020 and has no criminal antecedent. Chargesheet has been submitted in the case. So far as the deceased Sadanand Paswan is concerned, the specific allegation of assault by farsa is on Manti Devi.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with the petitioner having remained in custody for over 1 year, the Court directs the petitioner to be enlarged on bail in connection with Sikty P.S. Case no.154 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria.
