JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-03-2017 The application is for grant of anticipatory bail in connection with Mohiuddinnagar P.S. Case No. 102 of 2016 registered for offences under sections 395 and 398 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that except the information of the Spy, there is nothing against the petitioner and there is no specific allegation. Statement of all the witnesses have been recorded and only on the basis of two reports of Spy, petitioner has been made accused in this case. Heard learned A.P.P. also.
Having heard both sides and from perusal of the record it appears that, the petitioner was in consistent touch with
Patna High Court Cr.Misc. No.9923 of 2017 (2) dt.06-03-2017 2/2 other accused persons and paragraph 3 of this petition also shows that the petitioner is an accused in one more case except this, as such, this Court is not inclined to grant anticipatory bail to the petitioner. However, he may surrender before the court below and make prayer for regular bail, which will be considered by the court below on its own merit, without being prejudiced by this order. Accordingly, this petition is disposed of.
