2. The petitioner has preferred this application for grant of regular bail in connection with Khirimore P.S. Case No. 04/2024 dated 04.01.2024 registered for the offence punishable u/s 341, 323, 325, 307, 452 and 379 read with Section 34 of the Indian Penal Code.
3. As per the prosecution case, On 02.01.24 at about 5:30 P.M., the petitioner and the co-accused persons entered the informant's house holding lathi-danda, bricks, stones, iron rod and a pistol and started abusing and assaulting the informant's wife. On hearing the noise, the informant, his younger brother, his mother and his sister-in-law came out of their house to save
Patna High Court CR. MISC. No.16086 of 2025(3) dt.03-04-2025 2/3 the informant's wife, then they were also assaulted with lathidanda, bricks, stones and iron rod. In the meantime, the petitioner assaulted on the head of the informant with an iron rod, causing injury. After this, Jarnadhan Yadav snatched a gold chain from the informant's neck and Minta Devi snatched the informant's wife ear ring and the co-accused Manish Kumar snatched the informant's brother Mahaviri. Further, the petitioner assaulted the informant's younger brother with the butt of the pistol, causing injury. Thereafter, the injured were taken to Rampur Nagwan Government Hospital, where the doctor referred the informant to AIIMS, Patna.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Learned counsel has submitted that the injury is caused by hard and blunt substance but as per the impugned order, the injury report issued by the AIIMS, Patna shows that weapon used as sharp. The petitioner has one antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 23.10.2024.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Danapur, Patna in connection with Khirimore P.S. Case No. 04/2024.
7. The application stands allowed.
