The petitioners are accused in connection with Manjhagarh P.S. Case No. 14 of 2020, registered under Sections 30(a), 41 and 45 of the Bihar Excise Act, 2016. The accusation is that in course of patrolling duty, information received information about keeping the illicit liquor in the village Maghi Nimuiya Chaur then he along with other police personnel reached there in the early morning. On seeing the police person, 5-6 persons started to flee away from the field but on chased, two persons were apprehended, who disclosed their names as Ramakant Sahni (petitioner no.2) and Sandesh

Patna High Court CR. MISC. No.10025 of 2020(2) dt.29-02-2020 2/2 Kumar Sahni (petitioner no.1). On query, apprehended persons also disclosed the name of two persons as Manish Sahni and Rajesh Sahni, who succeeded to flee away. On search, 2745 bottles each containing 180 ml Indian made foreign liquor was recovered from the field.

Learned counsel for the petitioners submits that petitioners have no criminal antecedent and are in custody since 10.01.2020.

Having regard to the facts and the circumstances of the case, the petitioners above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge-cum-Special Judge, Excise, Gopalganj, in connection with Manjhagarh P.S. Case No. 14 of 2020. Out of two sureties, one surety must be the close relative of the petitioners.
