Petitioner apprehends arrest in connection with Madanpur P.S. Case No. 161 of 2021 registered for the offence punishable under sections 379, 420, 467, 468, 469, 486, 120B of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely because he is owner of the vehicle in question. Nothing has been recovered from the conscious possession of this petitioner. As a matter of fact, petitioner had given his vehicle to one Prashant Kumar Singh on rental basis vide

Patna High Court CR. MISC. No.11950 of 2022(2) dt.11-05-2022 2/2 agreement contained in Annexure-2. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing of his personal bond to the satisfaction of Special Judge, Excise, Aurangabad in connection with Madanpur P.S.
