The petitioner seeks bail in Malsalami P.S. Case No. 180 of 2016 registered under Sections 399 and 402 of the Indian Penal Code, Sections 20 and 22 of N.D.P.S. Act and Sections 25(1-b), 26 and 35 of the Arms Act.

The police arrested the petitioner along with Randhir Thakur and others. From the possession of the petitioner, three live cartridges and one Samsung mobile bearing SIM No. 9470892027 were recovered.

It is submitted that the petitioner is in jail since 07.07.2016. Other co-accused Randhir Thakur from whose possession one loaded country made pistol was recovered and he has also got criminal antecedent, has already been enlarged on bail by a co-ordinate bench of this Court in Cr. Misc. No. 2509 of

Patna High Court Cr.Misc. No.11865 of 2017 (2) dt.18-03-2017 2/2 2017.

Considering the facts aforesaid and only three live cartridges were recovered from the possession of the petitioner and the petitioner has got no criminal antecedent, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge-X, Patna in Malsalami P.S.
